Historic Victory For Guard Comes On Its 375th Birthday

H.R. 1540 Conference Report Analysis and Highlights

Highlights of relevant sections of the reported out bill, H.R. 1540, are described below:

  • Sec. 131: Reduces the floor for Air Force strategic airlift from 316 to 301.
  • Sec. 112: Requires Army to offer C-23 aircraft to states upon retirement and requires a report on title 10 and title 32 capabilities.
  • Removed in Conference: Does NOT require the AF to transfer C-12 aircraft to the Army (Senate bill language of S. 1867, Sec. 156).
  • Sec. 312: Improves Sikes Act coverage of state owned facilities used for National Defense.
  • Sec. 362: Instructs the Comptroller General of the United States to conduct a review of the Department of Defense system for Space-Available travel.
  • Sec. 511 and Sec. 512: Includes the Chief of the National Guard Bureau as a member of the Joint Chiefs of Staff and re-designates the position of the Director of the Joint Staff of the National Guard Bureau as the Vice Chief of the National Guard Bureau.
  • Sec. 515: Authorizes RC members to active duty for preplanned and budgeted missions (12304).
  • Sec. 518: Requires that whenever officers of the armed forces are considered for appointment to the position of Commander, Army North Command or Commander, Air Force North Command, fully qualified officers of the National Guard and Reserves must be considered for these positions.
  • Sec. 575: Extends rights under the Uniformed Services Employment and Reemployment Rights Act to certain National Guard duty under title 32 when such service was authorized by the President or Secretary of Defense for the purpose of responding to a national emergency declared by the President and supported by federal funds.
  • Sec. 611- The conferees agreed to a 1.6 percent increase in military pay.
  • Sec. 651- Establishes a Death Gratuity and related benefits for Reserves who die during an authorized stay at their residence during or between successive days of inactive duty training.
  • Sec. 661: Requires the Secretary of Defense to provide a report on basic allowance for housing for National Guard members transitioning between full-time National Guard duty under title 32, United States Code, and active duty under title 10, United States Code.
  • Sec. 703: Authorizes the Secretary of Defense to provide members of the reserve components performing inactive duty training during scheduled unit training assemblies access to mental health assessments with a licensed mental health professional.
  • Sec. 1003A: Requires that the Department of Defense, in its future-years defense program submitted with its annual budget request, to display separately the estimated expenditures and item quantities for each reserve component of the armed forces.
  • Sec. 1080A: Requires the Secretary of Defense to submit to Congress a report setting forth an analysis of the costs of a sample of deployable units of the active components of the armed forces and the costs of a sample of similar deployable units of the reserve components of the armed forces.
  • Sec. 1085: Authorizes up to $3M for US and foreign civilian personnel participating in the SPP program.
  • Sec. 4101 and 4102: $325 million for National Guard and Reserve Equipment.

The final vote is expected in the House by Wednesday or Thursday and in the Senate by Thursday or Friday.
